Welcome to Fumeblast Hosting, a service provided by Fumeblast Company LLC, headquartered in Ventura County, California, USA. By purchasing or using our services, you agree to the following Terms of Service.

1. Eligibility

You must be 18 years or older to use our services. By registering, you confirm you meet this requirement.

2. Services Provided

We provide Web Hosting, Game Servers (Minecraft, Holdfast: Nations At War, Garry’s Mod, FiveM), and TeamSpeak voice servers. You may install mods and custom content unless such content violates laws or our policies.

3. Account Registration

You must provide accurate information when registering. You’re responsible for your account activity and must notify us if your account is compromised.

4. Payments & Billing

All payments are processed securely via Stripe. Subscriptions auto-renew unless canceled. No refunds are provided for any reason, except under the specific conditions outlined for backordered game servers in the Backorders section. If payment is not received by the due date, your server may be suspended. If an invoice remains unpaid for 10 days after its due date, a late fee of 25% of the unpaid amount, with a minimum of $5.00, will be applied. If an account has a negative balance for 10 or more consecutive days due to an unpaid invoice, all active services on the account will be suspended, even if those specific services have been paid for. Suspended services will continue to be invoiced during the suspension period. No new services may be ordered until the account balance is settled, and any payments for new services while the account is negative will not be refunded. If an account remains in a negative balance for 30 consecutive days, all associated services and data will be permanently deleted. Creating another account to evade unpaid invoices or a ban is not permitted and will result in the termination of all services without refund. If an invoice is unpaid for more than 3 days, the associated service and its data may be permanently deleted.

5. Backorders

This policy applies to game servers only. Other services, such as Web Hosting, will be marked as out of stock and cannot be ordered until they are available. If a game server is ordered while out of stock, it will be placed on backorder. Backordered game servers will be provisioned as soon as stock becomes available. The renewal date for the service will be pro-rated to begin on the day the service is fulfilled, not the day it was ordered. Backordered game servers are the only services eligible for a refund. A refund for a backordered service can be requested within 1 hour of placing the order, or at any time before the order has been fulfilled, whichever comes first.

6. Game Hopping Policy

This policy applies to Game Hosting services only. Customers are permitted to "hop" or switch their game server to a different game type (e.g., from Minecraft to Rust) on the same plan or an equivalent plan one (1) time per calendar month. A "calendar month" is defined as the period from the first day of the month to the last day of the month. This feature is subject to stock availability for the desired game.

7. Prohibited Activities

We prohibit the following: Hosting illegal or pirated content, network abuse or spam, harassment of other users or staff, attempted unauthorized access. Violation may result in immediate suspension or termination of services.

8. Sponsorships

If you are under a sponsorship agreement with Fumeblast Hosting, you and your community must act in good standing at all times, including within the games you play. We reserve the right to terminate your sponsorship at any time for any reason, including but not limited to, behavior that reflects poorly on Fumeblast Hosting.

9. Affiliate Program

Participants in our affiliate program are subject to the full Affiliate Program terms. Faking referrals, including referring yourself, is a direct violation of these terms and will result in the immediate deactivation of your affiliate account, forfeiture of all accrued earnings, and a full ban of your main account and any fraudulent accounts, along with their services. We reserve the right to refuse payouts and deactivate accounts for any reason. Please see the full Affiliate Program terms for details.

10. Support

We offer support via our support portal. Response times may vary but we strive to respond promptly during business hours.

11. Termination

We may suspend or terminate services for any violation of these terms. Users may also terminate service at any time, but we do not offer refunds.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of California, USA, with exclusive venue in Ventura County. All disputes shall be resolved by binding arbitration, unless otherwise required by law.

1. Uptime Guarantee

Fumeblast Hosting guarantees a 99.9% network and hardware uptime every month, excluding scheduled maintenance.

2. Service Credits for Downtime

In the event that we do not meet the 99.9% uptime guarantee, we will provide service credits to affected customers upon request. Downtime is defined as the inability to access your service due to network or hardware failure within our control.

• 2+ hours of downtime: 1 day of service credit.
• 6+ hours of downtime: 3 days of service credit.
• 12+ hours of downtime: 5 days of service credit.

3. Credit Request and Exceptions

To receive a credit, you must open a support ticket within 7 days of the downtime event. Downtime must be confirmed by our internal monitoring systems. The SLA does not apply under the following circumstances:

• Scheduled maintenance announced on our status page or via email.
• Delinquent customer accounts (unpaid invoices).
• Customers in breach of any Fumeblast Hosting Terms and Conditions and policies.
• Downtime caused by the customer's own configurations, scripts, or third-party software.
• DDoS attacks, unless they are a result of a failure in our mitigation systems.

4. Payment Processing

All payments are handled by Stripe, a third-party provider. We do not store full payment card data on our servers.

We use cookies and similar technologies for: Session management, site performance, analytics. You can manage your cookie preferences in your browser settings.

6. International Users

If you are outside the U.S., your data may be transferred to and processed in the U.S., where data protection laws may differ from those in your country.

7. Your Rights (California Residents)

Under the CCPA, California residents may: Request a copy of their personal data, ask us to delete their data, request disclosure of what personal data we collect. To exercise these rights, please contact us via our support portal.

8. Data Retention

We retain your data only for as long as necessary to provide services. Once an account is deleted or inactive for an extended period, we may permanently erase associated data.

Rules & Requirements

• Program referrals are only available for game packages.
• Your Fumeblast Hosting account must be in good standing (no negative balance, no ToS violations). If your account is not in good standing, your affiliate account will be deactivated, and all referrals and commission amounts will be lost.
• The email address on your payout PayPal account must be the same as the email on your Fumeblast Hosting account.
• We reserve the right to deactivate your affiliate account for any reason and refuse payouts if we believe referrals are not genuine. Faking referrals, including creating accounts for yourself through your link, is a violation of our Terms of Service and will result in the immediate termination of all services and a full ban on both your main account and the fraudulent accounts, along with forfeiture of all funds.
